It’s time to get all your portrait clients under an easy to use contract! Clearly lay out the expectations your clients can have from you, accurately describe the terms of service, and make it known what you need to have to be successful as their photographer.

We developed this Portrait Contract Template over the course of a year to address the most important aspects of photographing a client’s portrait session. It was reviewed several times with the advice of lawyers, clients, and from our own experiences in photographing thousands of portrait sessions. The intent is not to cover every nuance related to the photographic process, and no contract can address every scenario. We do our best here to discuss likely issues that need to be covered and provide a mechanism for resolving those issues.

The template is ready-to-use as is, but we recommend tailoring it to your business. It can be used as a paper document or installed into your studio management software (such as ShootQ.) Every provision has an explanation written with it and resources necessary for you to adjust it for your business’s state and country.

  1. The conditions of these TERMS OF USE supersede any and all prior agreements whether oral or written between Twig & Olive Photography LLC and the Purchaser as identified on the Bill of Sale. In the event that any provision of these TERMS OF USE are found to be invalid or unenforceable pursuant to judicial decree or decision, the remainder of this agreement shall remain valid and enforceable. By purchasing these Actions, Action Sets, Presets, Preset Collections, and/or ACR Settings, the Purchaser, as identified on the Bill of Sale, hereby agrees to all terms and conditions set forth in these TERMS OF USE.
  2. All Actions, Action Sets, Presets, Preset Collections, and ACR Settings are copyrighted by Twig & Olive Photography LLC, which retains all copyrights and moral rights, including those not expressly granted in this agreement, to each and every Action, Action Set, Preset, Preset Collection or ACR Setting, as well as all instructional content, indefinitely.
  3. All Actions, Action Sets, Presets, Preset Collections, and ACR Settings may be used in the production of personal and/or commercial images.
  4. All Actions, Action Sets, Presets, Preset Collections, and ACR Settings may not be resold, redistributed, disseminated, mimicked, reproduced (in whole or in part), or shared in anyway to a third party. The Purchaser, as identified on the Bill of Sale, is allowed One (1) license per person or per business.
  5. Due to the downloadable nature of this product, NO refunds will be given for any reason.
  1. If the Purchaser, as identified on the Bill of Sale, violates the terms of this TERMS OF USE, irreparable harm shall occur, and money damages shall be insufficient to compensate Photographer. Therefore, Twig & Olive Photography LLC shall be entitled to seek injunctive relief (i.e., a court order) to enforce these TERMS OF USE. The prevailing party shall have the right to collect from the other party reasonable costs, both compensatory and punitive damages, and necessary disbursements and attorneys’ fees incurred in enforcing these TERMS OF USE.
  2. In the event that there is a dispute regarding these TERMS OF USE, the parties agree these disputes shall be resolved through binding arbitration. A panel of three arbiters shall be selected, one by each party and the third by agreement of the party-appointed arbiters. Arbitration shall take place in Dane County, Wisconsin and shall be governed by Chapter 788 of the Wisconsin statutes and other applicable Wisconsin law. The decision of the arbiters shall be binding and conclusive as to all disputes and as to all parties to this agreement.
  3. It is agreed that the laws of the State of Wisconsin shall govern this agreement.
